VALUATION DISPUTES

At The BVA Group, many of our valuation professionals are also litigation experts.  Thus we maintain a unique perspective as compared to those pure valuation firms who do little or no litigation consulting as part of their practice.  We consider each litigated valuation matter as a blank slate rather than pursuing a "cookie-cutter" approach, such that our opinions not only adhere to the applicable professional valuation requirements and legal standards of proof, as well as, survive the scrutiny by opposing parties.  Certain valuation standards allow for flexibility in reporting requirements with respect to valuation engagements in the context of litigation.  However, all valuation standards require that all developmental standards are adhered to.

Our experts have significant experience in numerous types of valuation disputes, including:

  • Partner/shareholder disputes
  • Marital dissolutions
  • Bankruptcy
  • Minority shareholder oppression
  • Post M&A disputes
  • Distribution of estate and trust assets
  • Triggered buy/sell agreement
  • Loss of business value disputes
  • Statutory mergers and appraisal rights valuations

Through research, continuing education, and by maintaining active roles in the various professional valuation organizations, our experts stay abreast of the most recent applicable court cases, legislation, and professional trends.  Our professionals possess an in-depth knowledge of all proven and accepted valuation approaches and methodologies.  We utilize and maintain numerous valuation resources, such as industry, market and economic data, which help us produce reliable valuation analyses and reports that adhere to the all applicable valuation standards and are expected to survive the scrutiny of cross-examination.

As in other types of litigation, our valuation experts are often called upon to provide expert testimony at trial or arbitration.  However, we are also often engaged as consulting experts to assist in analyzing a case during its early stages.  The BVA Group's valuation experts can be utilized in various capacities to assist in a given matter, such as:

  • Early case assessment;
  • Identifying key valuation issues;
  • Assessing the magnitude of various aspects of a case;
  • Analyzing the opposing side's valuation opinions;
  • Assist in settlement negotiations and mediation;
  • Assisting in discovery requests;
  • Preparation of expert valuation reports;
  • Preparing counsel for deposition and cross examination of opposing side's experts; and
  • Providing expert witness testimony.
